Terms of Use

These Terms of Use (“Terms”) govern your use of the GiveAway website at giveawayworld.online, its mobile versions and related services (together, the “Platform”). The Platform is operated by GiveAway India, New Delhi (“we”, “us”, “our”).

These Terms are an electronic agreement. You accept them electronically when you create an account, which is valid under the Electronic Transactions Act B.E. 2544 (2001). No signature on paper is needed.

Our Privacy Policy, Community guidelines and Cookie Policy form part of these Terms.

GiveAway is an online platform that lets people give away things they no longer need, free of charge, to other people nearby. We act as an intermediary under the Information Technology Act, 2000.

• We do not own, inspect, store, deliver or guarantee any item listed on the Platform.
• We are not a party to any exchange between members. Each exchange is an arrangement between the giver and the receiver.
• Giving items is free only. Selling, renting, bartering, asking for deposits or any other payment for an item is not allowed. The separate Services section, where independent providers offer paid home services, has its own rules: the Service terms and the Provider terms.

• You must be at least 18 years old and able to enter into a binding contract under the law of the country where you live.
• Give accurate information and keep it up to date. One personal account per person.
• Keep your password and verification codes secret. You are responsible for everything done through your account.
• Tell us immediately at support@giveawayworld.online if you think someone else has accessed your account.
• We may ask you to verify your email address or mobile number, and we may refuse or close accounts that we reasonably believe are fake or misused.

• You may list only items that you own or are entitled to give away, that are legal to give in India and that are not listed in our prohibited items.
• Descriptions and photos must be accurate, honest and your own.
• We may review, edit the category of, hold, reject or remove any listing, at any time, to keep the Platform safe and lawful.
• Listings are shown for 30 days unless removed earlier.
• You decide at your sole discretion who receives your item, provided you do not act unlawfully.

• A request is not a guarantee. The giver chooses who receives the item.
• We may limit the number of requests per week to keep things fair.
• Request items for your own use or to pass on to someone in need — not to resell them.
• Check the item when you collect it. Items are given “as is”.
• Share your handover code only when the item has been handed to you.

You keep ownership of the photos, text, messages and reviews you post (“Your Content”). You grant us a non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce, resize, translate and adapt Your Content for the purpose of operating, improving and promoting the Platform. This licence ends when Your Content is deleted, except where we must keep it by law or where it has already been shared with other members (for example, messages and reviews).

You are responsible for Your Content and confirm that it does not infringe anyone’s rights.

In line with Rule 3(1)(b) of the IT Rules, you must not host, display, upload, modify, publish, transmit, store, update or share any information that:

1. belongs to another person and to which you do not have any right;
2. is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or promoting enmity between groups on the grounds of religion or caste with the intent to incite violence;
3. is harmful to children;
4. infringes any patent, trademark, copyright or other proprietary rights;
5. deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;
6. impersonates another person;
7. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting another nation;
8. contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
9. violates any law for the time being in force.

You must also not: ask for or offer money or anything in exchange for items; send spam or bulk requests; create multiple accounts or use someone else’s; get around limits, bans or security measures; use bots, scrapers or automated tools; collect other members’ personal data; harass, threaten or discriminate against anyone; or use the Platform for any unlawful purpose.

You are responsible for your own safety when communicating and meeting with other members. Please follow our Safety tips. We do not run background checks on members. The Verified badge only means that a member’s email address has been confirmed and their mobile number has been checked — it does not confirm identity, character or the condition of any item.

We may remove or disable access to any content, restrict features, or suspend or terminate any account that breaches these Terms, the law or our guidelines, or that we reasonably believe puts other members at risk. Where appropriate we will tell you the reason and give you the opportunity to respond.

Where required by law we may preserve information, including after an account is closed, and share it with government agencies that are lawfully authorised to request it.

You may stop using the Platform at any time and ask us to delete your account by writing to support@giveawayworld.online from your registered email address.

You can report any listing, profile or message using the Report button. For complaints about content, these Terms or the handling of your personal data, see Complaints and feedback. We acknowledge complaints within 2 working days and aim to resolve them within 15 days.

If you are not satisfied with our answer, you may contact the Office of the Consumer Protection Board (OCPB), hotline 1166.

The GiveAway name, logo, design and software belong to us or our licensors. You may not copy, modify or use them without our written permission, except as needed to use the Platform normally.

The Platform is provided “as is” and “as available”. To the extent permitted by law, we make no promises about the quality, safety, legality, condition or suitability of any item, the accuracy of any listing, the conduct of any member, or that the Platform will always be available or error-free.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss or damage arising from items exchanged, meetings between members, or the acts or omissions of any member. Because the Platform is free, our total liability to you for any claim relating to the Platform is limited to ₹1,000. Nothing in these Terms limits liability that cannot be limited under Indian law.

You agree to compensate us for any claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms or the law, or from Your Content.

We may change the Platform or these Terms from time to time. We will show the date of the latest version at the top of this page and inform you of important changes on the Platform or by email. If you continue to use the Platform after a change takes effect, you accept the updated Terms.

These Terms are governed by the laws of India, where the Platform is operated. If you use the Platform as a consumer in Thailand, you keep the protection of the consumer laws of Thailand that cannot be set aside by agreement, and nothing in these Terms limits your right to bring a claim before the courts or authorities of Thailand where those laws allow it.

If any part of these Terms is found invalid, the rest remains in force. Not enforcing a right is not a waiver of it. These Terms are available in more than one language; if there is any difference, the English version applies.

• You see listings from Thailand only, and you must follow the laws of Thailand when you give or receive items.
• Items that are illegal or restricted in Thailand may not be listed. This includes e-cigarettes and vapes, alcohol and tobacco, medicines, weapons, and products made from protected wildlife. The full list is in the Community guidelines.
• Giving is always free. Nobody may ask you for a fee, a deposit or a delivery charge for a free item.
• We do not deliver items and we are not a party to the handover. Meet in a safe, public place — see Safety tips.

The English version of these Terms is the binding one. Translations are provided for convenience only.
